Start with the benefit, not the vendor name
Employee benefits can include health insurance, meals, transport, fitness membership, travel and other facilities. These categories do not share one GST credit answer. Identify the actual inward supply and the relevant section 17(5) restriction or exception before assigning a credit code to the supplier.
A single benefits administrator may invoice several services with different treatment. Ask for enough detail to separate those components and connect them with the underlying policy. A statement that the programme improves retention is a business rationale, not a complete legal basis for claiming every GST amount.
Preserve the policy and employment arrangement
Keep the current benefit policy, employment terms, eligibility criteria and approval records. Record who receives the benefit and which entity is responsible. A policy belonging to a parent company does not automatically establish the receiving subsidiary's contract or credit entitlement.
Where employees contribute or reimburse costs, retain the calculation and payroll or payment records. These facts can matter to the overall arrangement, but recovery should not automatically be treated as either a taxable onward supply or proof of credit eligibility. Assess the actual contract and current law rather than selecting whichever label creates the preferred outcome.
Illustratively, a technology company arranges group health insurance, a gym package and business-travel tickets through one administrator. The file should identify each service and beneficiary category. Claiming the entire bill under a broad employee-welfare description would hide restrictions that differ across those components.
Separate perquisite supply treatment from input credit
CBIC Circular 172/04/2022 discusses perquisites provided under the employer-employee contractual arrangement and their supply treatment. That is a different question from whether tax on the employer's inward purchase is blocked. A benefit can fall outside an outward supply analysis while its input credit still requires the section 17 review.
Do not use the absence of output tax as a shortcut to either allow or deny every input credit. Identify the actual inward category, business connection, any exception and the other statutory conditions. Keep a separate conclusion for each issue so staff do not treat one circular paragraph as a universal employee-benefit exemption.
The same distinction applies when payroll records show the benefit as part of compensation. That accounting or employment treatment helps explain the arrangement, but it does not rewrite the specific GST clauses concerning insurance, membership, food or vacation travel.
Identify actual obligations under law
Where relying on the employer-obligation exception, identify the law requiring provision of the relevant goods or services and show why it applies to this employer, establishment and employee population. Circular 172 clarifies the scope of the clause (b) proviso, but a voluntary internal policy does not automatically become an obligation imposed by law.
Keep the statutory reference, applicability assessment and any supporting establishment records with the supplier contract. Do not copy a workforce threshold from another State or sector without checking the governing legislation. The required facility and covered persons may differ from the broader programme management has chosen to offer.
If the package exceeds the legal obligation, identify that fact openly. Benefits for covered workers, dependants, senior management or leisure extensions may require different review. An obligation supporting one component should not silently be extended to an entire bundled invoice without analysing the additional elements.
Review travel, membership and vehicle facts distinctly
Vacation travel benefits such as leave travel concessions have a specific restriction under clause (b). Business travel should be distinguished from that category, with itinerary, purpose and participant evidence. A trip combining a customer visit with a family holiday needs a factual separation rather than one blanket business declaration.
Club, health and fitness membership and certain insurance supplies also need their own clause review. For transport or vehicles, identify approved seating, the service model and relevant exceptions. Do not assume any employee journey is passenger-transport business activity merely because a transport vendor issued the invoice.
Maintain category-specific records proportionate to the claim. A transport roster, insurance schedule, meal service record and business-travel itinerary answer different questions. The evidence should establish the facts relevant to the selected provision rather than require every employee to supply an identical unnecessary document pack.
When a benefit changes during the year, preserve its earlier policy version and effective dates. A new insurance category or expanded dependent cover should not inherit the old conclusion without review. The invoice period may straddle the change, so the preparer needs the actual coverage schedule and price allocation. This makes later adjustments understandable without claiming the revised policy always applied.
Reconcile invoices and maintain decisions
Confirm the correct recipient GSTIN, service period, beneficiary scope and tax particulars. Match the amount with current supplier reporting information and retain payment allocations for any applicable condition. A benefit approved in policy but invoiced to another entity still raises a recipient issue that the policy cannot cure.
Record the amount allowed, blocked, allocated or held pending clarification and the reason. Keep supporting documents for any exception and a review trigger when the policy, law, beneficiary group or supplier contract changes. An eligibility decision should attach to the arrangement and transaction, not permanently to the vendor.
A well-organised benefit file allows HR, finance and the tax preparer to contribute different facts without confusing their roles. HR explains the policy, operations confirms delivery and finance connects invoices and payments. The resulting credit decision can then be made from a clear record of the actual benefit and applicable conditions.
